PRIVACY POLICY

Effective as of April 1, 2025

PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE USING SERVICES OR WEBSITES provided by Cal-Ore Communications, Inc. (“Cal-Ore”).

 

1. COMMITMENT TO PRIVACY. Cal-Ore is committed to respecting the privacy rights of customers, visitors, and other users of its websites (“Sites”).  Consistent with this commitment, Cal-Ore believes that when customers use any of Cal-Ore’s products or services, they should understand when and how personal information is collected, used, disclosed, and protected. Cal-Ore created this Privacy Policy (the “Policy”) to give customers information and confidence as they visit and use Cal-Ore’s Sites, and to demonstrate Cal-Ore’s commitment to transparency, fair information practices, and privacy protection. This Policy is only applicable to Cal-Ore’s Sites, and not to other services offered by any other website or application that customers may be able to access from Cal-Ore’s Sites.  By using the Sites, customers are consenting to the collection and use of personal information as described in this Policy. 

 

2. WHAT INFORMATION DOES CAL-ORE COLLECT ABOUT YOU?  Cal-Ore collects information about users of its products or services in the normal course of its business, including through its Sites.  When you visit or browse a Cal-Ore Site, you may provide Cal-Ore with personal information that can be directly associated with a specific person or entity, website use information regarding a group or category of services or customers.  Cal-Ore may also collect information from other authorized sources and combine it with your account information.

2.1 Personal Information.  Cal-Ore collects information you provide when you purchase, contract for, or use a Cal-Ore product or service.  This information is used for billing purposes so you can be appropriately charged (and, in some cases, to investigate fraudulent usages).  For example, we may collect:

    • Name
    • Mailing address
    • E-mail address, content of e-mail messages, and responses
    • Credit card number
    • Telephone numbers
    • Other personal information (e.g., mother’s maiden name)
    • Passwords used for accessing Cal-Ore’s Sites.

2.2 Website Information.  Cal-Ore’s web servers automatically receive certain types of information when you use a Cal-Ore Site, for example, your domain name and IP address(es), date and time of visits, the type of browser you use, the website from which your visit originated, page visits, time spent on individual web pages, and other similar website “traffic data.”  No other personal information about you is revealed in this process. Cal-Ore may sometimes use the “cookies” feature of major browser applications that store a small piece of data on your computer about your visit to Cal-Ore’s Sites.  Cal-Ore does not include any personally identifiable information in cookies.  Cal-Ore only uses cookies to collect website use information so that it can determine how to improve its Sites, complete transactions you may request, and track your selections in order to make appropriate recommendations about Cal-Ore products and services. You can generally choose whether to accept cookies by changing the settings on your website browser. However, if you choose to disable this function, your experience at a Site may be limited or diminished, and some features may not work as they were intended.

2.3 Information from Other Sources.  Cal-Ore may obtain information about you from outside sources and add it to or combine it with your account information.  For example, Cal-Ore may receive credit information when you subscribe to one of Cal-Ore’s plans.  Cal-Ore may also use marketing information from third parties to help better serve you, or inform you about other products or services.  Cal-Ore sometimes receives updated delivery and address information from its shippers or other sources.  Cal-Ore also receive information from agents from whom you purchase Cal-Ore products or services.

 

3. HOW DOES CAL-ORE USE THE PERSONAL AND WEBSITE INFORMATION THAT IT COLLECTS?  Cal-Ore uses your personal and website use information in order to provide optimal customer service, engage in its business activities, and inform you about other products or services.

3.1 Use of Personal Information. Cal-Ore does not share your personal information with any third parties without your consent, except as necessary to provide you with products or services or to comply with applicable laws.  Cal-Ore may use your personal information to verify your identity, check your qualifications for services, or follow up with transactions initiated on Cal-Ore Sites.  Cal-Ore may also use your contact information to send you additional information about Cal-Ore.  If at any time you do not wish to receive these communications, please let Cal-Ore know (see contact information below).  When Cal-Ore uses other agents, contractors, or companies to perform services on its behalf, Cal-Ore advises them that they are to protect your confidential information and not disclose such information except in limited circumstances.

3.2 Use of Website Information.  Cal-Ore uses aggregate information to analyze its Sites’ traffic, but Cal-Ore does not examine this information for individually identifying information.  Cal-Ore may use anonymous IP addresses to help diagnose problems with its servers, administer its Sites, or display website content according to your preferences. Traffic and transaction information may also be shared with business partners and advertisers on an aggregate and anonymous basis.

3.3 Use of Information to Protect Cal-Ore and Others.  Cal-Ore will disclose personal information only if required to do so by law, or in good-faith belief that it needs to do so in order to (1) conform or adhere to legal requirements, (2) protect and defend the rights or property of Cal-Ore or the users of its Sites, or (3) act in case of emergency to protect the safety of the public or users of its Sites.

 

4. CALIFORNIA CONSUMER PRIVACY ACT (CCPA).  If you are a California resident, you have certain rights pursuant to the California Consumer Privacy Act.  These CCPA rights may only apply in certain circumstances and are subject to certain exemptions.  The following provides a summary of your rights.  You can exercise these rights by contacting Cal-Ore using the contact information identified below.

4.1 Right to Know.  You may request that Cal-Ore disclose to you:  (1) the categories and/or specific pieces of personal information Cal-Ore has collected about you, (2) the categories of sources for that personal information, (3) the purposes for which Cal-Ore uses that information, (4) the categories of third parties with whom Cal-Ore discloses the information, and (5) the categories of information that Cal-Ore sells or discloses to third parties.

4.2 Right to Delete.  You can request that Cal-Ore delete personal information that Cal-Ore collected from you and tell its service providers to do the same, subject to certain exceptions, including some contexts in which Cal-Ore is legally required to keep the information.

4.3 Right to Opt-Out of Sale or Sharing.  You may request that Cal-Ore stop selling or sharing your personal information (“opt-out”).  In that event, Cal-Ore cannot sell or share your personal information after it receives your opt-out request unless you later authorize Cal-Ore to do so at a later time.  Because Cal-Ore does not sell or share your personal information with third parties, except as necessary to provide you with products or services or to comply with applicable laws, there is no need to exercise the right to opt-out.

4.4 Right to Correct.  You may ask Cal-Ore to correct inaccurate information that it has about you.

4.5 Right to Limit Use and Disclosure of Sensitive Personal Information.  You can direct Cal-Ore to only use your sensitive personal information (such as your social security number, financial account information, your precise geolocation data, or your genetic data) for limited purposes, such as providing you with the services you requested.

4.6 Right to Non-Discrimination.  Cal-Ore cannot deny goods or services, charge you a different price, or provide a different level or quality of goods or services just because you exercised your rights under the CCPA.

 

5. CHILDREN’S ONLINE PRIVACY PROTECTION ACT.  Cal-Ore’s Sites are general audience websites, and Cal-Ore does not direct or specifically facilitate access to any content for children under 13 years of age.  Cal-Ore understands and is committed to respecting the sensitive nature of childrens’ privacy online.  Cal-Ore also recognizes that many parents purchase products and services for family use, including use by children under 13, without Cal-Ore’s knowledge.  Any information collected from such accounts would appear to Cal-Ore as the personal information of the subscribing adult customer, and will be treated as such under this Policy.  If Cal-Ore makes available offers and products online where a child informs us that he or she is under the age of 13, or Cal-Ore otherwise learns or has reason to suspect that a Site’s user is under 13, Cal-Ore will ask a parent to confirm his/her consent in advance of further collection, use, or disclosure of personal information from that child.  At any time, parents may review the personal information collected, ask to have it deleted, and refuse to allow any further collection or use of their child’s information.

 

6. PLACEMENT OF ADVERTISING ON OTHER WEBSITES. Cal-Ore may place advertisements for its products or services on other websites, or use third-party ad companies to place advertisements about its products and services on other websites. These companies may use cookies and other technology to measure the effectiveness of Cal-Ore’s advertisements. To measure advertising effectiveness and offer selective ad content, the advertisement serving companies may use anonymous information about your visits to Cal-Ore’s and other websites. However, the advertisement serving companies use an anonymous number to identify you — not your name, address, phone number, email address, or anything that personally identifies you. The use of such cookies is subject to the ad serving company’s privacy policy, not this Policy.

 

7. NETWORK AND INFORMATION SECURITY.  Cal-Ore maintains a variety of physical, electronic, and procedural safeguards to prevent the loss, misuse, and alteration of the information that Cal-Ore obtains from you.  These include encryption of customer records when electronically transmitted, firewalls and password protection measures, and secure file stores for physical records.  Cal-Ore is devoted to employing reasonable measures to promote data security, but Cal-Ore cannot guarantee its ability to prevent loss, misuse, or alteration of such information.

 

8. UPDATING THIS POLICY.  Cal-Ore may revise, amend, or modify this Policy from time to time.  Notice of any revision, amendment, or modification will be posted on Cal-Ore’s website, and/or on your start pages and/or by email and/or in mailings to your primary Cal-Ore email account and will be effective on the date noted in the posting.  This Policy may not be amended or modified by you except by means of a written document signed by both you and an authorized representative of Cal-Ore.  By continuing to use Cal-Ore’s services and products after the amendments are effective, you accept and agree to abide by them.

 

9. THIRD PARTY WEBSITE AREAS BEYOND CAL-ORE’S CONTROL.  The Sites may contain links to other websites. If you choose to visit other websites, Cal-Ore’s Policy is no longer in effect.  Cal-Ore is not responsible for the privacy practices or content of other websites, and it is your responsibility to review the privacy policies of other websites to ensure that you agree to their policies.
